Judge rejects plea agreement in fake cancer case | Richmond Times ...

A judge this morning rejected a plea agreement that would have resulted in no jail time for a Mechanicsville woman who investigators said faked a serious cancer condition to collect money.

After the ruling in the case of Martha Nicholas, defense and prosecution lawyers conferred and told the judge they had agreed to continue the case to Feb. 17.

Under the agreement that was rejected by General District Judge Robert Laney, Nicholas would have pleaded guilty to two misdemeanor charges of obatining money by false pretenses and made restitution.

Nicholas, 42, had been under investigation for months after she appeared at cancer rallies and solicited money, sometimes wearing a "Cancer Sucks" T-shirt.? She collected under $2,000, according to evidence.

"Our investigation revealed no evidence of any cancer treatment at any medical facility that had been publicly identified by Martha Nicholas during her many public appearances and testimonials," police said after her arrest last month.

The investigation had started with an anonymous tip.

Sam Simpson, an attorney for Nicholas, said he is considering a defense that would include the argument that a mental impairment played a factor in Nicholas' actions.

Attorneys confirmed that there has been an interest in Nicholas appearing on national television relative to her condition, but that she has been advised against that while her case is pending.
